Legalized/certified translations: The UK

A sworn translation consists of a copy of the original document bearing an apostille, accompanied by the translated text, an affidavit, and the requisite duty stamps.

American certificates MUST always be legalized by means of Apostille. It is the applicant’s responsibility to request the legalization by the relevant authorities BEFORE requesting the certification of a translation .

• duty stamps (in 2023 a 16€ duty stamp on the 1st page of the translation and every 5th page)

Affidavit/sworn statement

Swearing an Affidavit is usually required when you are presenting your translation as evidence in court, Giudice di Pace (Justice of the peace), Notai (Italian Notary Public). In Italian, it is the ‘verbale di giuramento’.

Apostille

An Apostille verifies the authenticity of the signature of the clerk, officer, registrar and ensures that the document is recognised in all states that signed the Hague Convention of 1961; it does not endorse the content of the document. Find out more and see a list of Apostille Countries.

UK Apostille

Countries not within the Hague convention need a Legalization seal.

In case you need a translation from English into another language, Italian translation is a must if you ask a sworn translation in Italy.

A legalized translation is carried out by a professional translator and includes their signed declaration to this effect. In the UK, a certified translation serves as the equivalent of a sworn translation. Certified translations have no legal value in Italy, unless it is provided to an Italian consulate in the UK.

In the UK, a legalized translation is a literal, word-for-word translation accompanied by a signed “Certificate of Accuracy”. Unlike many other countries, the UK. does not have “sworn” or “government-licensed” translators; instead, any professional translator or company can certify a document by attesting to its accuracy

The certification of a translation can only be issued upon submission of the original document and for the following categories of documents only:

• British certificates (with Apostille) for use in Italian public offices

The term “legalized” typically refers to two additional layers of verification depending on the document’s destination: 

• Notarization: A Notary Public verifies the identity of the person signing the certification statement. This is often required for court or specialized legal proceedings.
• Apostille: If a Britissh document is being sent abroad to a country in the Hague Convention, it may need an Apostille. This is a state-level authentication of the notary’s seal, not the translation itself.
